‘Knowingly’

Facts and circumstances an employer should have known or been aware of when hiring an employee–that the employee is an illegal immigrant and is not authorized to work in the United States. If an employer is caught ‘knowingly’ hiring illegal immigrants, then the employer often has to pay a monetary fine.

Knowingly hiring also applies to subcontracts, especially where the prime contractor is a Federal contractor, there are other penalties that may also be applicable for knowingly hiring unauthorized workers. They could also be criminal penalties for repeat offenders, and employers may have to enter into long-term agreements of a plan to report hiring practices; training employees in correct I-9 management; correcting I-9 hiring issues; and discriminatory practices.
